Although the chemical composition delta-9 is the same whether it derives from hemp or cannabis, federal law distinguishes between the two plants in a crucial way. Only high-THC cannabis and the Delta-9 it contains are prohibited under the Controlled Substances Act. Contrarily, the 2018 Farm Bill effectively makes Delta-9 lawful as long as it is made from hemp. The only restriction is that 0.3% or less of the dry weight of Delta-9 THC may be present in hemp products. About 1,100 mg of Delta-9 THC might be included in a 12 oz beverage while still under 0.3% of the overall weight.
